		<description>My mom passed away last November.   In Jan., I filed a small claims affidavit on the land adjoining our home where my family and my mom all lived for the past thirty years.  I became a stay at home care-giver to my Mom in 1996 after she went through some major health issues.  We refinanced the house several times to keep up with medical costs and others. During the last refinance of the first mortgage the title company wanted to only put my mom and husband on the deed and when they did the wording in joint tenancy was not put back on the title as it had previously been.  So while trying to refinance and consolidate mortgages now the title company says we must go back to step one and get a probate attorney to file for the interest of my mom which can not be assumed by us in a new refinance loan.?  My siblings have already signed off that I was to inherit my mom's estate which consisted of the home we shared so can I just file another small claims affidavit for the portion of interest (50%)of our house that would be necessary for the court instead of hiring a lawyer and tying up our already stressed finances for even longer?</description>
